1. Acceptance of Terms

By accessing or using the website of Expert Property Care ("we," "us," or "our") at https://expertpropertycare.ca, or by engaging our services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.

2. Services

Expert Property Care provides professional landscaping, lawn maintenance, snow removal, hardscape construction, fence installation, irrigation systems, and related property care services in Georgetown, Ontario and surrounding areas in the Greater Toronto Area.

All services are subject to availability and may vary based on location, season, and property conditions. We reserve the right to refuse service at our discretion.

3. Estimates and Pricing

  • All estimates are provided free of charge and are valid for 30 days from the date of issue unless otherwise stated.
  • Final pricing may vary from initial estimates if site conditions differ from what was assessed or if the scope of work changes.
  • Any changes to the agreed scope of work must be approved by both parties before additional work begins.
  • Prices are quoted in Canadian dollars (CAD) and are subject to applicable taxes.

4. Payment Terms

Payment terms will be outlined in your service agreement or invoice. Unless otherwise agreed upon:

  • A deposit may be required for larger projects before work begins.
  • Invoices are due upon receipt or within the time frame specified on the invoice.
  • Late payments may be subject to additional fees or suspension of services.

5. Cancellation and Rescheduling

We understand that schedules change. Please provide at least 24 hours' notice for cancellations or rescheduling of scheduled services. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.

For seasonal contracts (lawn maintenance, snow removal), early termination terms will be outlined in your service agreement.

6. Weather and Delays

Our services are subject to weather conditions. We reserve the right to reschedule services due to inclement weather, unsafe conditions, or other circumstances beyond our control. Snow removal services are triggered based on snowfall accumulation as outlined in your service agreement.

7. Warranty and Workmanship

We stand behind the quality of our work. Specific warranty terms vary by service:

  • Hardscape installations: We warranty our workmanship. Material warranties are provided by the manufacturer.
  • Plantings: We provide care instructions and recommendations. Plant survival depends on proper watering and maintenance by the property owner.
  • Lawn care: Results depend on weather conditions, soil quality, and adherence to recommended care schedules.

8. Limitation of Liability

To the maximum extent permitted by law, Expert Property Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to our services or website.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

9. Property Access and Responsibility

By engaging our services, you grant us reasonable access to your property to perform the agreed-upon work. You are responsible for:

  • Informing us of any underground utilities, sprinkler systems, or other hidden features on your property.
  • Ensuring pets and personal property are secured during service visits.
  • Marking property boundaries if requested.

10. Website Use

You agree to use our website for lawful purposes only. You may not:

  • Use the website to transmit harmful, threatening, or objectionable content.
  • Attempt to gain unauthorized access to our systems.
  • Reproduce, distribute, or modify any content on our website without our prior written consent.

11. Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Expert Property Care and is protected by Canadian copyright and trademark laws. You may not use our content without prior written permission.

12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
